Committee Establishment

The Campus Security & Emergency Response (CSER) Committee was established on August 19, 2014 (formerly as the Jeanne Clery Committee) to address the concerns of Campus Security and Safety internal and external of campus grounds to maintain federal compliance under the Clery Act and Higher Education Act.

Purpose Statement

The purpose of the Campus Security & Emergency Response (CSER) committee is to ensure and maintain compliance of Diné College campus safety, security, policies and procedures, and fire and crime reporting.

CSER Committee Goals

1. Compliance – To maintain on-going PASSING performance under the Jeanne Clery Act and meeting all safety compliance of Diné College under Department of Education.

2. Communication – To communicate safety guidelines, policies and procedures of the institution’s campus safety efforts and provide timely notification and reporting on campus crimes.

3. Training– To engage the Clery Act committee in training opportunities that will enhance knowledge and awareness of campus safety & security policies, as well as providing campus safety & security training for college community.

2019-2022  History

COVID-19 Pandemic and institution activated Incident Command Center, moving all operation and control under Commander, Velveena Davis, including oversight of Campus Security.  CSER members were placed under Commander Davis on managing campus security response for all site and centers, as well as COVID response.

 

2023 to 2024

ICC sunset, however, role and responsibility Commanding role of Davis continue to manage network with Campus Security, Vice Presidents and Center Directors to re-open sites and return back on-site. CSER Committee will re-activate once all personnel have returned back to campus and within roles. First CSER meeting was held in Spring 2023 on February 4, 2023. Campus Security Supervisor, Clifford James, retired and Interim Emery Deschine took on the new role while we search for a permanent Security Supervisor.

Dine' College entered into MOU agreement with Shiprock Associated Schools, Inc. under the titled, "Community Partnership in Safety" to provide shared efforts on emergency response, shared man-power and resources, etc. Point of Contact for MOU is Velveena Davis (Lead), Winifred Jumbo (Co-Lead), Sya Deschine (Security), and Gabriel Smart (SASI Incident Commander).

 

 

History

The Clery Act, also known as The Jeanne Clery Disclosure of Campuses Security Policy and Campus Crime Statistics Act – 20 USC § 1092(f), is a federal law requiring institutions of higher education who receive federal student financial aid funds to disclose campuses crime statistics and provide information regarding safety and security policies. The United States Department of Education (ED) is responsible for monitoring the compliance of this act and may impose financial penalties against institutions found in violation of the law in addition to suspending their participation in federal financial aid programs.

This legislation, originally passed in 1989 and signed into law in 1990, was known as the Crime Awareness and Campus Security Act. The law was later named in memory of Jeanne Clery who, in 1986, was assaulted and murdered on the Lehigh University (PA) campus in her residence hall. The law was amended in 1992, 1998, and 2000. The mist recent changes were due to the Higher Education Opportunity Act (Public Law 110-315) amending the Clery Act in 2008.

This legislation can be one of the most cumbersome and difficult laws that higher education professionals have to work with other then the FERPA legislation. To that end, in 2005, the Department of Education published the Handbook for Campus Crime Reporting to assist college and university personnel in the navigation of the reporting requirements and compliance. Then in 2008, the Higher Education Opportunity Act amended the Clery Act as well as the Higher Education Act of 1965, thereby adding new campuses safety and security requirements. As a result of this legislation, the Department of Education published The Handbook for Campus Safety and Security Reporting in 2011 as an updated and expanded version of the original handbook.

Higher Education Actions on Campus Safety and Annual Reporting

  • Require institutions to maintain statistics about the number of incidents.
  • Revise the definition of “rape” to reflect the Federal Bureau of Investigation's (FBI).
  • Revise the categories of Clery Act hate crime reporting to add gender identity and to separate ethnicity and national origin into independent categories.
  • Require institutions to provide and describe in their annual security reports primary prevention and awareness programs to incoming students and new employees.
  • Require institutions to provide and describe in their annual security reports ongoing prevention and awareness campaigns for students and employees.
  • Define the terms “awareness programs,” “bystander intervention,” “ongoing prevention and awareness campaigns,” “primary prevention programs,” and “risk reduction.”
  • Require institutions to describe each type of disciplinary proceeding used by the institution.
  • Require institutions to list all of the possible sanctions that the institution may impose following the results of any institutional disciplinary proceedings for an allegation of dating violence, domestic violence, sexual assault, or stalking.
  • Require institutions to describe the range of protective measures that the institution may offer following an allegation of dating violence, domestic violence, sexual assault, or stalking.
  • Require institutions to provide for a prompt, fair, and impartial disciplinary proceeding in which;
  1.  Officials are appropriately trained and do not have a conflict of interest or bias for or against the accuser or the accused
  2.  The accuser and the accused have equal opportunities to have others present, including an advisor of their choice
  3.  The accuser and the accused receive simultaneous notification, in writing, of the result of the proceeding and any available appeal procedures. 
  4.  The proceeding is completed in a reasonably prompt timeframe
  5.  The accuser and accused are given timely notice of meetings at which one or the other or both may be present
  6.  The accuser, the accused, and appropriate officials are given timely access to information that will be used after the fact-finding investigation but during informal and formal disciplinary meetings and hearings.
  • Define the terms “proceeding” and “result.”

The Clery Act requires colleges and universities to:

Publish an Annual Security Report (ASR) by October 1, documenting three calendar years of select campus crime statistics including security policies and procedures and information on the basic rights guaranteed victims of sexual assault. The law requires schools make the report available to all current students and employees, and prospective students and employees must be notified of its existence and given a copy upon request. Schools may comply with this requirement via the internet if required recipients are notified and provided exact information regarding the on-line location of the report. Paper copies of the ASR should be available upon request. All crime statistics must be provided to the U.S. Department of Education.

To have a public crime log. Institutions with a police or security department are required to maintain a public crime log documenting the "nature, date, time, and general location of each crime" and its disposition, if known. Incidents must be entered into the log within two business days. The log should be accessible to the public during normal business hours; remain open for 60 days and, subsequently, made available within two business days upon request.

Disclose crime statistics for incidents that occur on campus, in unobstructed public areas immediately adjacent to or running through the campus and at certain non-campus facilities including Greek housing and remote classrooms. The statistics must be gathered from campus police or security, local law enforcement and other school officials who have "significant responsibility for student and campus activities.” The Clery Act requires reporting of crimes in seven major categories, some with significant sub-categories and conditions:

  1. Criminal Homicide
    1. Murder & Non-negligent manslaughter
    2. Negligent manslaughter
  2. Sex Offenses
    1. Forcible
    2. Non-Forcible
  3. Robbery
  4. Aggravated Assault
  5. Burglary, where:
    1. There is evidence of unlawful entry (trespass), which may be either forcible or not involve force.
    2. Unlawful entry must be of a structure - having four walls, a roof, and a door.
    3. There is evidence that the entry was made in order to commit a felony or theft.
  6. Motor Vehicle Theft
  7. Arson

Schools are also required to report statistics for the following categories of arrests or referrals for campus disciplinary action (if an arrest was not made):

  1. Liquor Law Violations
  2. Drug Law Violations
  3. Illegal Weapons Possession

Hate crimes must be reported by category of prejudice, including race, gender, religion, sexual orientation, ethnicity, and disability. Statistics are also required for four additional crime categories if the crime committed is classified as a hate crime:

  1. Larceny/Theft
  2. Simple Assault
  3. Intimidation
  4. Destruction/Damage/Vandalism of Property

​Issue timely warnings about Clery Act crimes which pose a serious or ongoing threat to students and employees.  Institutions must provide timely warnings in a manner likely to reach all members of the campus community. This mandate has been part of the Clery Act since its inception in 1990. Timely warnings are limited to those crimes an institution is required to report and include in its ASR. There are differences between what constitutes a timely warning and an emergency notification; however, both systems are in place to safeguard students and campus employees.

Devise an emergency response, notification and testing policy. Institutions are required to inform the campus community about a “significant emergency or dangerous situation involving an immediate threat to the health or safety of students or employees occurring on the campus." An emergency response expands the definition of timely warning as it includes both Clery Act crimes and other types of emergencies (i.e., a fire or infectious disease outbreak). Colleges and universities with and without on-campus residential facilities must have emergency response and evacuation procedures in place. Institutions are mandated to disclose a summary of these procedures in their ASR. Additionally, compliance requires one test of the emergency response procedures annually and policies for publicizing those procedures in conjunction with the annual test.

Compile and report fire data to the federal government and publish an annual fire safety report. Similar to the ASR and the current crime log, institutions with on-campus housing must report fires that occur in on-campus housing, generate both an annual fire report and maintain a fire log that is accessible to the public.

Enact policies and procedures to handle reports of missing students. This requirement is intended to minimize delays and confusion during the initial stages of a missing student investigation. Institutions must designate one or more positions or organizations to which reports of a student living in on-campus housing can be filed if it’s believed that student has been missing for 24 hours.

  • State Laws and Regulations

    Currently, the Navajo Nation prohibits the use of marijuana and criminal penalties can be imposed on individuals who violate the Nation’s drug laws, such as possession of marijuana, production or delivery of marijuana, and delivery of marijuana to minors.

    HEHSC members approved Legislation No. 0083-­‐15 with a vote of 3-­‐0. The legislation now moves forward to the Law and Order Committee for consideration. The Navajo Nation Council serves as the final authority on the legislation.

    Recently the laws have accepted marijuana use in the State of Arizona under certain guidelines and restrictions. For some this can be a gateway to their new business or allow their medical marijuana consumption to be legal. Having all these new laws in place also allow for improper usage and may still be a felony in the State of Arizona. Prop 203 will not protect the possession or distribution of marijuana for non-medical use — that would still be a crime, punishable by fines up to $150,000, up to 18 months in prison for less than two pounds, and up to three years in prison for more than four pounds.
